Definitions
In this text the following words should have the following meanings:
Film-Scoring.com -- Film-Scoring.com georg brandt, untermarkstr. 56 a, 44267 dortmund, germany.
Site -- the internet web site run by Film-Scoring.com to make available its services
Customer -- any person joining Film-Scoring.com by using the web site's registration form
Partner -- a customer that has agrred to work with another customer using the site
Track -- a piece of music supplied (e.g. uploaded) by a customer
Film -- a film, movie or video supplied (e.g. uploaded) by a customer
Applicant -- a customer applying for a project by submitting a track
Reviewer -- a cusomer opening a film project for submissions and reviewing submitted tracks
Material -- a track or a film
General
These Terms and Conditions shall apply to all contracts for the supply of services by Films-Scoring.com to the customer and shall prevail over any other documentation or communication from the customer. Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by Films-Scoring.com. Nothing in these Terms and Conditions shall prejudice any condition or warranty, express or implied, or any legal remedy to which the Supplier may be entitled in relation to the Services, by virtue of any statute, law or regulation. Nothing in these Terms and Conditions shall affect the customer's statutory rights as a consumer.
Membership
For some features (e.g. applying for a feature film) the customer needs VIP status. This status is given the customer by Film-Scoring.com's sole discretion and will be decided upon the customers CV and documented work. The IMDb will be considered as a data source for this. The customer shall have no implicit or explicit right to be given a VIP status. The VIP status can also be removed by Film-Scoring.com's discretion. Every customer can apply for VIP status.
Member Information
Every customer is obliged to enter his personal information into the registration form inlcuding full first and last name. Fantasy names or abbreviations are not accepted.
Member Status
Film-Scoring.com has the right to immediately terminate the membership of any customer without notice if he or she does not follow these Terms & Conditions.
Proper Use & Quality
Film-Scoring.com is striving to deliver high qulaity contents. A customer continously submitting improper material, abusive content, hidden or open advertisements or spamming can be immediately excluded or even banned from further service without further notice. An applicant continuously receiving very low scores for his submissions is likely to be considered a spammer.
Pricing
The utilization of the site is free of charge unless it is explicitely stated differently. For details please see the F.A.Q. section. The functionality offered to the customer may vary depending on the members status and/or extra services payed for.
Ownership
For any original material, the customer's private right of copyright shall be maintained and recognised. The customer may only upload materials that he holds the rights for. No rights are transferred neither by uploading material to the site, nor by agreeing for a project using the site. Film-Scoring.com highly recommends that the customer consults a lawyer bevor trading or exchanging matarials with the partner.
Severance
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.
